INTRODUCTION

("Cashpo" or "Company" or "us", "We") have developed a mobile application cashpo(Application/App) through which you may apply for loans granted by various NBFC's(Non Banking Financial Company) or Banks.Here NBFC's and Banks are referred as LENDER. LENDER has appointed and authorized us to collect, store, authenticate, verify and distribute the Personal Information (defined below) as may be required by LENDER to sanction the Loan. The Personal Information shall be collected through the mobile application form (Mobile Application Form) available on the Application

("Cashpo" or "Company" or "us", "We") are committed to protecting and respecting your privacy.We recommend you to read this Privacy Policy carefully so that you understand our approach towards the use of your Personal Information.

PERSONAL DATA COLLECTED

In order to avail the Services, you are required to register with the Company by logging in through Third Party Platforms (defined below) (User Account). During the application process, you shall be required to share/upload certain personal information, your name, e-mail address, gender, date of birth, mobile number,passwords,photograph, reference contacts,mobile phone information including contact numbers, data and login-in credentials of Third Party Platforms (defined below), employment info like your employer details , address of employer office , financial information such as bank documents, salary slips, bank statements, PAN card, bank account no., data from Credit Information Companies, data required for Know Your Customer compliances, requirement and other relevant details (Personal Data). You undertake that you shall be solely responsible for the accuracy and truthfulness of the Personal Data you share with us.

As part of the Services, you authorize us to import your details and Personal Data dispersed over Third Party Platforms. Third Party Platforms are social networking platforms, such as Facebook, Google ,LinkedIn and other similar platforms.

During the application process, you shall be required to share/upload certain personal information as below:

• Name

• Address

• Contact information (which include mobile numbers and email IDs)

• 2 reference contact details

• Employment detail

• Bank details

• Documents such as : PAN card, Aadhar card, Bank statement, Current address proof (if Rented) and Selfie etc.

LOCATION TRACKING

You understand and acknowledge that the Company reserves the right to track your location (Track) during the provision of the Services, and also in the event that you stop, cease, discontinue to use or avail the Services, through the deletion or uninstallation of the Mobile App or otherwise, till the event that your obligations to pay the Outstanding Amount(s) to LENDER, exist. Deletion, uninstallation, and/or discontinuation of our Services, shall not release you from the responsibility, obligation and liability to repay the Outstanding Amount(s).

 

FINANCIAL SMS

 

We assess your credit profile from your transactional SMSs, in order to increase your chances of credit approval. The assessment is automated and the SMSs are encrypted. We do not share your SMS data with any third party app or service. We do not access or store your personal SMSs

 

 

CAMERA

 

We require camera access to take selfie, scan and capture the required KYC documents thereby allowing us to auto-fill relevant fields.

 

 

GOVERNING STATUTE

This Privacy Policy is governed by and is compliant with the Information Technology( Reasonable Security Practices and Procedures and Sensitive Personal Data or Information)Rules 2011, which is designed to protect Personal Information of the End-User(s) of the Services; and other applicable rules and regulations related to privacy.

·         Joint Marketing Arrangements: Where permitted by law, we may share your Information with joint marketers with whom we have a marketing arrangement, we would require all such joint marketers to have written contracts with us that specify the appropriate use of your Information, require them to safeguard your Information, and prohibit them from making unauthorized or unlawful use of your Information

We will retain your Personal Information for as long as your registration with us is valid and the Outstanding Amount(s) is due and payable to LENDER. We may also retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Subject to this section, we will try to delete your Personal Information upon reasonable written request for the same. Please note, however, that there might be latency in deleting Personal Information from our servers and backed-up versions might exist even after deletion.

 

How Do We Protect Your Information?

 

We implement a variety of security measures to maintain the safety of your information when you place an order or enter, submit, or access your information. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential. After a transaction, your private information (credit cards, social security numbers, financials, etc.) is never kept on file. We cannot, however, ensure or warrant the absolute security of any information you transmit to us or guarantee that your information on the Service may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, technical, or managerial safeguards.

You are responsible for all actions that take place under your User Account. If you choose to share your User Account details and password or any Personal Information with third parties, you are solely responsible for the same. If you lose control of your User Account, you may lose substantial control over your information and may be subject to binding actions.

The rights you have to request updates or corrections to the information Cashpo collects depend on your relationship with Cashpo. Personal may update or correct their information as detailed in our internal company employment policies.

 

Customers have the right to request the restriction of certain uses and disclosures of personally identifiable information as follows. You can contact us in order to (1) update or correct your personally identifiable information, (2) change your preferences with respect to communications and other information you receive from us, or (3) delete the personally identifiable information maintained about you on our systems (Subject to this privacy policy and terms and Conditions of our company), by cancelling your account. Such updates, corrections, changes and deletions will have no effect on other information that we maintain, or information that we have provided to third parties according to this Privacy Policy before such update, correction, change or deletion. To protect your privacy and security, we may take reasonable steps (such as requesting a unique password) to verify your identity before granting you profile access or making corrections. You are always responsible for maintaining the secrecy of your unique password and account information . Subject to any applicable laws, any communication shared by you via the Platform or through the blogs, reviews or otherwise to us (including without limitation contents, images, audio, financial information, feedback etc.. collectively Feedback) is on a non-confidential basis, and we are under no obligation to refrain from reproducing, publishing or otherwise using it in any way or for any purpose. You shall be responsible for the content and information contained in any Feedback shared by you through the Platform or otherwise to us, including without limitation for its truthfulness and accuracy. Sharing your Feedback with us, constitutes an assignment to us of all worldwide rights, titles and interests in all copyrights and other intellectual property rights in the Feedback and you authorize us to use the Feedback for any purpose, which we may deem fit.

COMMUNICATIONS FROM THE PLATFORM

·         Special Offers and Updates: We may send you information on products, services, special deals, and a newsletter of the Company. Out of respect for your privacy, we present you with the option of not receiving these types of communications. You may unsubscribe via the unsubscribe mechanism provided in each such communication or by emailing us at [email protected]

 

·         Service Announcements: On certain occasions or under law, we are required to send out Service or Platform related announcements. We respect your privacy, however you may not opt-out of these communications. These communications would not be promotional in nature.

 

·         Customer Service: We communicate with Customer(s) on a regular basis to provide requested services and about issues relating to their User Account. We reply via email or phone, based on customer(s) requirements and convenience.

 

THIRD PARTY CONSENT

 

You authorize us to share your personal information, documents (such as Aadhar, PAN), employment details, bank account details or any other information provided by you in the Cashpo application while applying for loan to the Third party for analyzing your bank statement, fetching your credit history, verification of your KYC, payment through payment gateway or any other such activity as may be required for the completion of lending process.

 

 

SHARING WITH THE CO-LENDING PARTNER

 

We work with identified banks and financial institutions to provide co-lending products on the App, and we may share your information with such Co-Lending Partner(s).

SALE OF BUSINESS

 

We reserve the right to transfer information to a third party in the event of a sale, merger or other transfer of all or substantially all of the assets of Cashpo or any of its Corporate Affiliates (as defined herein), or that portion of Cashpo or any of its Corporate Affiliates to which the Service relates, or in the event that we discontinue our business or file a petition or have filed against us a petition in bankruptcy, reorganization or similar proceeding, provided that the third party agrees to adhere to the terms of this Privacy Policy.

INDEMNIFICATION

You agree to indemnify us, our subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees and hold us harmless from and against any claims and demand, including reasonable attorneys fees, made by any third party arising out of or relating to: (i) Personal Information and contents that you submit or share through the Platform; (ii) your violation of this Privacy Policy, (iii) or your violation of rights of another Customer(s).

LIMITATIONS OF LIABILITY

You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, information, details or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) unauthorized access to or alteration of your Personal Information.

GOVERNING LAWS AND DUTIES

You expressly understand and agree that the Company, including its directors, officers, employees, representatives or the service provider, shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from; (a) use or the inability to avail the Services (b) inability to use the Platform (c ) failure or delay in providing the Services or access to the Platform (d) any performance or non-performance by the Company (e) any damages to or viruses that may infect your electronic devices or other property as the result of your access to the Platform or your downloading of any content from the Platform and (f) server failure or otherwise or in any way relating to the Services.

FORCE MAJEURE:

This Agreement shall be construed and governed by the laws of India and courts of law at Raipur CG shall have exclusive jurisdiction over such disputes without regard to principles of conflict of laws.

 

REPAYMENT

 

Repayment of your loan done from your mobile application (Cashpo) are directly linked with NBFC’s bank account for Third party services like Razorpay, which is used for safe and secure transactions.

Note:- Cashpo does not collect any amount from you in its own bank account for any service.

 

FORGET/DELETE DATA FROM APP

ABOUT OUR LOAN

 

CASHPO IS AN INSTANT PERSONAL LOAN APPLICATION FOR SALARIED PERSONS, WHERE THEY CAN APPLY FOR A PERSONAL LOAN STARTING FROM RS 5000 TO 200000 AS PER THEIR REQUIERMENTS. OUR TENURE RANGES FROM 3 MONTHS TO 12 MONTHS.

Loan amount: ₹ 30,000 at Fixed interest rate of 27.60% p.a(Equivalent Reducing Interest Rate of 40.94%)

Loan Duration: 3 Months

Total personal loan interest = ₹ 2,070

Processing fees (PF) + GST = ₹ 1,694.92 + ₹305.08 =₹ 2,000

Total Deductible (PF + GST): ₹ 2,000

In-Hand Amount : Loan Amount - Total Deductibles = ₹ 30,000 – 2000 = ₹ 28,000

Total repayable Amount (Loan Amount + Interest): ₹ 32,070

Monthly EMI Repayable (Loan Amount + Interest / No of EMI’s): ₹ 10,690

PF + GST are deducted upfront during the loan disbursal.

Sample 2:

Loan amount: ₹ 30,000 at Fixed interest rate of 27.60% p.a.(Equivalent Reducing Interest Rate of 47.58%)

Loan Duration: 12 Months

Total personal loan interest = ₹ 8,280

Processing fees (PF) + GST = ₹ 1694.92 + ₹ 305.08 = ₹ 2000

Total Deductibles (PF + GST): ₹ 2000

In-Hand Amount : Loan Amount - Total Deductibles = ₹ 30,000 – 2000 = ₹ 28,000

Total repayable Amount (Loan Amount + Interest): ₹ 38,280

Monthly EMI Repayable (Loan Amount + Interest / No of EMI’s): ₹ 3,190

PF + GST are deducted upfront during the loan disbursal.

Note:- We do not ask users in our app to make repayment in full in 60 days or less from the date the loan is issued.

If users wish to foreclose their loans they can do on their own.
